How is property divided on divorce in Thailand?
Short answer
The Civil and Commercial Code distinguishes personal property, which each spouse keeps, from marital property, which is in principle divided between them. A valid prenuptial agreement can vary the default.
Characterising an asset is the real work: property owned before marriage, gifts and inheritances typically remain personal, while income and assets acquired during the marriage are usually marital. Mixed funding complicates the analysis.
Uncontested divorce by mutual consent is registered at the district office; contested cases go to court. The division mechanism and the evidence needed differ significantly between the two routes.
