Does a child with a foreign father acquire Thai nationality?
Short answer
Yes, where the mother is Thai. The Nationality Act confers Thai nationality by descent on a child born to a Thai parent, whether the birth is in Thailand or abroad, and regardless of the parents' marital status.
Nationality by descent is not automatic in paperwork terms — it has to be documented. For a birth in Thailand, the district office issues the birth certificate and the child is added to a house registration; for a birth abroad, the parents register the birth at the Thai embassy or consulate, which issues a Thai birth certificate that can then be used to obtain a Thai passport and house registration entry.
Where the Thai parent is the father and the parents are not married, legitimation matters for parental rights even though nationality flows from a Thai mother independently: the father can legitimate the child by later marriage, by registration at the district office with the consent of mother and child, or by court judgment.
