Can a foreigner own 100% of a Thai company?

Short answer

Yes for activities that are not restricted under the Foreign Business Act, and yes for restricted activities where a licence, BOI promotion or a treaty route permits it. Otherwise foreign ownership in a restricted activity is capped.

The analysis is always activity-driven. Two companies with identical structures can reach opposite answers because one sells software and the other provides a listed service.

Where full foreign ownership is not available for the intended activity, the realistic options are a licence application, BOI promotion, or restructuring the activity itself — not nominee arrangements.
